Верховний Суд відхилив скаргу Верховної Ради на рішення Вищого адміністративного суду про визнання незаконним зняття парламентом недоторканності з депутата Ігоря Мосійчука (фракція Радикальної партії Олега Ляшка). Про це сказав головуючий суддя Петро Пантелеєнко, передають Українські Новини.

Він озвучив рішення колегії суддів Верховного Суду, згідно з яким у перегляді рішення Вищого адмінсуду відмовлено. Таким чином, скасовано постанову Ради про зняття недоторканності і схвалення арешту депутата Мосійчука.

Після оголошення вердикту Верховного Суду депутатський імунітет Мосійчука відновлений. Він зустрів оголошення зазначеного рішення оплесками.

При цьому під час судового засідання Мосійчук заявив, що готовий до повторного розгляду подання про свій арешт в Раді.

Адвокат депутата Леонід Сиваков заявив, що після винесення зазначеного рішення Верховного Суду усі кримінальні провадження проти Мосійчука повинні бути зупинені.

Як повідомляли Українські Новини, 15 березня Верховний Суд зупинив розгляд справи депутата Ради Мосійчука і вирішив просити пленум звернутися до Конституційного Судудля оцінки конституційності процедури зняття недоторканності з депутатів.

Пленум відмовився звертатися в КС з цього питання.

17 листопада 2015 року Вищий адмінсуд скасував зняття Радою недоторканності з Мосійчука.

Верховна Рада оскаржила зазначене рішення, і до вердикту Верховного Суду воно не могло набрати чинності.
