Нажатие кнопки «Like» в Facebook является проявлением свободы слова и защищено американской конституцией. К такому выводу пришел Апелляционный суд США, сообщает Agence France-Presse, пишет Главком.

Суд рассматривал иск жителя Вирджинии, который работал в управлении местного шерифа. По мнению истца, его уволили, потому что ему «понравился» политический противник его начальника, хотя он всего лишь воспользовался своим правом на свободу слова.

«Если пользователь нажимает «нравится» на странице избирательной кампании политика, он сообщает о своем одобрении этого кандидата, а кампания получает поддержку пользователя. Таким образом, это является эквивалентом размещения политической агитации у себя в палисаднике, что Верховный суд признал объектом свободы слова», — говорится в 81-страничном определении суда.

Теперь дело уволенного сотрудника будет пересмотрено в нижестоящем суде. Выдвигал ли житель Вирджинии какие-то требования в иске, не сообщается.

Первая поправка к конституции США запрещает посягать на свободы совести, слова, прессы и собраний, пытаться установить государственную религию, а также ограничивать право граждан обращаться к властям с жалобами.
