Вищий адміністративний суд України відмовив у відкритті касаційного провадження за касаційною скаргою КПУ, яка в судовому порядку намагалася оскаржити Правовий висновок Комісії з питань дотримання Закону України «Про засудження комуністичного та націонал-соціалістичного (нацистського) тоталітарних режимів в Україні та заборону пропаганди їхньої символіки». Даний висновок встановив невідповідність діяльності, найменування та символіки Комуністичної партії України вимогам українського законодавства.

Вищий адміністративний суд встановив, що «касаційна скарга є необґрунтованою, а викладені в ній доводи не викликають необхідності перевірки матеріалів справи, оскільки заявник не наводить підстав, які б дозволили вважати, що суд неправильно застосував норми матеріального або процесуального права».

Дана ухвала Вищого адміністративного суду України оскарженню не підлягає.

Таким чином, адміністративні суди дійшли висновку, що доводи представників і адвокатів Комуністичної партії України не є обґрунтованими. Тобто остаточно підтвердили правомірність вищезгаданого Правового висновку та відповідно заборону КПУ.
